GUARD AND CONTROL OF A VEHICLE
Warning!!! Contrary to what many people think, the Criminal Code does not only prohibit driving while under the influence of alcohol and / or drugs, but also by having possession and control of them.
Here are some situations where the consequences are the same as for driving while impaired:
- Be seated in the driver’s seat while under the influence of alcohol or drugs, in possession of the keys, even if the vehicle is not functioning;
- To be in his vehicle – even asleep in the back seat – and to be able to put it into operation (have the keys in his possession).
In each similar situation, the police officer will assess the possibility and the intent of the person. In the majority of cases, you will be charged with having possession and control of your vehicle while impaired by alcohol and / or drugs and it will be up to you to defend yourself in court to be acquitted of the charges against you.
